1. General Provisions

· For the purposes of these terms and conditions of use, the term “User” refers to any person who uses the services offered by the website www.biosolving.it, whether they merely consult the information contained therein or access the restricted areas.

· Use of the website is governed by these terms and conditions of use; acceptance of these terms constitutes an agreement between the User and the Website Owner and is implied by the mere act of browsing the web pages.

· The Data Controller may draw up additional terms and conditions to govern the individual services offered on the Website: the User is required to comply with these in order to use the relevant goods and services.

· The law applicable to relationships arising from the use of the service is Italian law, in accordance with which these terms and conditions of use must also be interpreted.

· The term “Service Provider” refers unequivocally to Via Gabriele D’Annunzio, 51 – 64014 Martinsicuro (TE).

· The Data Controller reserves the right to make changes, including substantial ones, to these terms of use at any time, notifying the User by publishing them on the Website.

· By continuing to use the service following any changes, the User fully accepts the new terms of use.

· The text contains terms specific to the IT sector which are widely recognised and have a clear meaning; unless otherwise stated, these terms are assumed to be known and understood by users of the website and the services offered therein.

2. The User’s rights and obligations.

· The User undertakes not to access restricted areas unless they are the genuine and legitimate holder of the login credentials.

3. Further obligations of the User.

· The User is required to use the website and the services offered therein in strict and constant compliance with the law, public order and public decency (including the customary rules relating to so-called netiquette), and with the provisions set out in these terms of use.

· Should the User access their personal account to add to or amend their personal data, they undertake to provide accurate information that is strictly necessary for the use of the services offered by Biosolving.

· Once the account has been activated, the User undertakes to use it, and in any event the user ID and password associated with it, in a lawful and proper manner, bearing in mind the legal consequences that may arise.

· The User must take due care and diligence in safeguarding their account username and password and, in the event of theft or loss, must promptly notify the Data Controller and request that the account be deactivated.

· The User must promptly notify the Data Controller of any loss or unauthorised use of their login credentials (user ID and password): in the absence of such notification, all expressions of intent, acts and events having legal effect carried out via the User’s account shall be deemed to have been performed by the User without dispute.

· Biosolving shall not be held liable in any way for the unauthorised access to personal data contained in the restricted area by unauthorised third parties who have gained knowledge of the User’s login credentials as a result of the User’s negligence.

· The User undertakes not to hinder other Users’ use of the service in any way.

· Users are prohibited from copying or otherwise accessing the contents of the website, in whole or in part, for any purpose other than strictly personal use and, in any event, for commercial use, subject to the relevant provisions of copyright and/or industrial property law.

4. The Data Controller’s obligations, warranties and disclaimers.

· The Data Controller undertakes to ensure that the User can access the website and the services offered therein online, as well as the associated communication tools, and to ensure that these are implemented in line with the current state of IT development.

· Without prejudice to the provisions of the previous point, given that certain pages of the Website are hosted on third-party web servers and managed by them, the Data Controller accepts no liability for any interruptions and/or suspensions of the service provided and/or for any other limitations on the usability of the service, in any part thereof, due to technical issues on its own part and/or on the part of third parties arising from factors or circumstances beyond its control. In the event of problems with the functioning of parts of the website, the user may report them to info@biosolving.it.

· The Data Controller reserves the right to use alternative and/or supplementary means of communication and/or publication alongside the Website, in order to make the services offered to Users accessible, including, but not limited to, the use of linking or mirroring techniques.

· The Owner shall not be liable for any use of this website and the services offered therein that contravenes the law, public decency or public order, or that is contrary to the provisions of these terms of use.
The Owner does not guarantee that the information posted on the website is up to date.

· The Data Controller has no control over links to other websites or the content of such websites appearing on its pages.
Where a link leads to a website offering additional services through the Data Controller, the use of such services shall be governed by the terms and conditions of use established by the service provider.

· The Data Controller shall not be liable for any damage and/or loss and/or malfunction and/or harm of any kind that may be caused to the User’s computer as a result of using the service provided by the Data Controller, nor for any contamination of the computer system resulting from access to, interconnection with, or downloading of material and computer programs from the website; the associated repair/restoration costs shall be borne by the User.
